PETITION / MEMORANDUM

based in Kallithea, Athens (El. Venizelou Av. 248), Greece.
Following the numbered P/2001/4015 denunciation concerning the violations of the Greek Legislature, in reference to the spirit and the decision of the C-375/95 of the EC.
Through this letter we want to inform you, that the new denunciated Legislature is opposed to the regulations of the EC treaty as it is in force currently (art. 90 EU) but also directly violates the above mentioned decision of the EC, as the Hellenic Democracy did not comply with the above decision.
Therefore there is a strong reason for direct implementation of the paragraph 2 of the article 228 EC.
We emphasize that the way the ‘Special Registration Tax’ (ETT) is defined, this special tax replaced - only by name - the ‘Special Consumption Tax’ (ΕΦΚ) and the ‘Lump sum Additional Special Tax’ (ΕΠΕΤ), introduces adverse discrimination between the domestic transferred automobiles and the "imported" of the same classification - From EU countries (thoughts 19,20,27,28,29,30 of the Decision C-375/95 EC).
Taking into consideration that the recent decision GOMEZ VALENTE was pronounced to the same spirit and refers to respective violations that took place in Portugal.
We want to bring to Your attention that there is already a serious delay of the part of the Commission (we submitted our denunciations 9 months ago to the
Direction General of the Internal Market - protocol number P/2001/4015 - as
well in the TAXUD) in the meanwhile it is detrimental to:
a) the intercommunity trading of second-hand automobiles to Greece and this situation harms irreparable the business of our members professionals that "import" and trade second-hand automobiles from the EU.
b) The Greek Consumer interests, are harmed strongly, because they do not have the possibility, as European Citizens, to have equal access in the market of descent second hand automobiles.
FOR ALL THESE REASONS WE WOULD REQUEST
Your immediate intervention in order to implement immediately the procedure of article 228 (former 171) par. 2 of the EC treaty.
