“ΤΕΚΜΗΡΙΩΣΗ ΕΠΙΣΤΟΛΗΣ ΜΑΣ ΥΠ’ ΑΡ. ΠΡΩΤ. 1582/1-9-2003” 
Κύριοι,
Σε συνέχεια της προηγούμενης επιστολής μας, επιθυμούμε να υποστηρίξουμε την αναφορά μας της 21/1/2004 με το παρακάτω έγγραφο, το οποίο εκδόθηκε από το 6ο Τελωνείο Πειραιά και απευθύνεται στην Ανώτατη Αρχή του στο Υπουργείο Οικονομικών της Ελλάδας. Η επιστολή αναφέρει την έλλειψη διοικητικών μέρων για τη σωστή εφαρμογή τροπολογίας του Ιουνίου 2003, που υποτίθεται ότι συμμορφώνει την Ελληνική Νομοθεσία με την Απόφαση του Ευρωπαϊκού Δικαστηρίου. Σας παραθέτουμε ακριβή μετάφραση του εν λόγω κειμένου:

        Αποτελεί πεποίθησή μας ότι το παραπάνω έγγραφο επαληθεύει 100% την αναφορά μας υπ’ αρ. 1582. Επίσης, είναι ολοφάνερο ότι η τροπολογία 3156/3-6-2003 είναι μια απλή επίφαση συμμόρφωσης, προκειμένου να γίνει επίδειξη δήθεν σεβασμού θεσμών της Κοινότητας όπως το ΔΕΚ. Κρίνουμε ότι είναι αναγκαία η δραστική παρέμβαση της Επιτροπής για απόλυτη εφαρμογή της Απόφασης του ΔΕΚ στην Υπόθεση C-393/98, καθώς έχουν ήδη εξαντληθεί όλα τα περιθώρια ανοχής.

Following to our previous above-mentioned letter, we would like to support our complaint of 21/1/2004 with the document below, issued by the Public Service: “6th Customs’ Service of Piraeus” and targeted to its’ Supreme Authority at the Hellenic Ministry of Finance. The letter deals with a report for the absence of administrative provisions, concerning the proper apply of the amendment of June 2003, which is supposed to “conform” the Hellenic Legislation to the European Court Decision C-393/98.         In reply to your above-mentioned petition ( by which you request the summon of the competent committee for inspection and definition of the taxable value of an imported from EU passenger car of type: HONDA CIVIC, as declared in the application with registration Nr.: 238/04, according to the legal amendment of Nr. 3156 in June 2003, which is added to the Hellenic Customs Law 2960/2001 ), we confirm to you that the present Hellenic Customs Law provides you with the right to request inspection of your car under importation by a committee of specialists, while this request has to be accompanied by the submission of an official certificate, proving the payment of a fee, whose figure is to be defined by a Ministerial decision. 
        Since no official directions still exist for the assembly of the above-mentioned committees, we shall forward your petition (of 13/1/2004) to the competent Services of the Hellenic Ministry of Financial Affairs. 
        We kindly request from “HELLENIC DIRECTORATE GENERAL OF CUSTOMS & REGISTRATION FEES” (supreme authority) and from “PREFECTURE OF ATTICA CUSTOMS’ SERVICES DEPARTMENT” (immediate superior authority), towards the above petition is forwarded, to inform our Service about further task procedures.
