THE EUROPEAN OMBUDSMAN
Sir,
we are the Hellenic Association of Automobile Merchants & Importers and we represent thousands of members from all over Greece. The reason of this letter is the unexpected illegal behavior of a Greek Consul, serving in the Hellenic Consulate of Milan – ITALY. The referred person insists on denying at the visitors of his Consulate the official verification on the authenticity of their signatures in documents declaring acts of car sale between an Italian seller and a Greek buyer. The Consul requests, instead of the plain written agreement, an official contract describing the terms of this sale, which is unnecessary at similar commercial transactions in European trade beyond State borders.
Our judgment is that such an act is totally illegal, since any so called obligation may be legal in Italy but could not be imposed in transactions with citizens of other countries involved, especially when these countries are also members of the EEC like Greece. In this way the representative of Hellenic State Services in Italy blocks free trading within the EEC and causes damage to merchants-members of our association, who cannot execute car purchases from citizens living in Milan.
Therefore we request hereby the intervention of the European Parliament aiming to conform the Greek Consul of Milan to the active European Market Laws and Practices.
